These Terms of Service ("Terms") govern your access to and use of the atlasvibetechnologies.comwebsite and the OdontoOS / SmileSetu software and related services (together, the "Services") provided by AtlasVibe Technologies Private Limited ("AtlasVibe", "we"). By using the Services you agree to these Terms.
1. Eligibility & accounts
You must be a business or professional capable of forming a binding contract under Indian law. You are responsible for the accuracy of your registration details, for safeguarding your credentials, and for all activity under your account. Notify us immediately of any unauthorised use.
2. Acceptable use
- Do not use the Services unlawfully or to infringe others' rights.
- Do not attempt to breach security, reverse-engineer, or disrupt the Services.
- Do not upload malicious code or data you have no right to process.
- You are responsible for obtaining all patient consents required for data you enter into the software.
3. Medical disclaimer
AtlasVibe products are practice-management software, not medical advice. They do not diagnose, treat, or make clinical recommendations. All clinical decisions are the practitioner's sole responsibility. The Services help clinics organise appointments, records, billing and communication; they are administrative tools. Nothing in the Services substitutes for professional clinical judgement, and we accept no liability for clinical outcomes.
4. Data roles — Fiduciary & Processor
For personal data of patients that a clinic manages using the software, the clinic is the Data Fiduciary (determining the purpose and means of processing) and AtlasVibe acts as the Data Processor, processing such data only on the clinic's documented instructions. In that capacity we will:
- process patient data solely to provide the Services;
- apply appropriate technical and organisational security measures;
- assist the clinic, as reasonably practicable, with data-principal requests and breach notifications;
- engage sub-processors only under equivalent obligations (see our Privacy Policy);
- on termination, delete or return patient data per the clinic's instruction and applicable law.
For personal data of website visitors and account holders, AtlasVibe is the Data Fiduciary, as described in the Privacy Policy.
5. Fees, billing & taxes
Paid plans are billed in advance per your selected cycle. All fees are in Indian Rupees and exclusive of GST, which is added as applicable. Refunds and cancellation are governed by our Refund & Cancellation Policy. We may revise prices with prior notice; changes apply from your next billing cycle.
6. Intellectual property
The Services, including all software, design and content, are owned by AtlasVibe and its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Services during your subscription. You retain all rights to the data you enter; you grant us the limited rights needed to operate the Services for you.
7. Availability & support
We aim for high availability but do not guarantee uninterrupted service. Planned maintenance is communicated in advance where practicable. Support is provided per your plan and via support@atlasvibetechnologies.com.
8. Disclaimer of warranties
Except as expressly stated, the Services are provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, AtlasVibe shall not be liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill. Our aggregate liability arising out of or relating to the Services shall not exceed the fees you paid to us in the twelve months preceding the claim.
10. Indemnity
You agree to indemnify AtlasVibe against claims arising from your misuse of the Services, your breach of these Terms, or your failure to obtain required patient consents.
11. Suspension & termination
You may cancel at any time as described in the Refund & Cancellation Policy. We may suspend or terminate access for material breach, non-payment, or legal requirement, with notice where practicable.
12. Governing law & jurisdiction
These Terms are governed by the laws of India. Subject to any binding arbitration or statutory forum, the parties submit to the exclusive jurisdiction of the courts at Pune / Pimpri-Chinchwad (PCMC), Maharashtra, India.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with a revised date and, where appropriate, notified by email. Continued use after changes take effect constitutes acceptance.
